Terms of Service

These terms are an agreement between you and MK Builds LLC (“Zarpo”, “we”), which builds and operates the Zarpo app and getzarpo.com. By creating an account or using Zarpo you accept them. Our Privacy Policy explains how we handle your information and is part of these terms.

1. The beta

Zarpo is in a private beta. Access is by invitation, and every member signs a Beta Tester Agreement in the app before using it. Where that agreement and these terms differ, the Beta Tester Agreement applies while you are a tester. Features may change, pause or be removed while the beta runs.

2. Who can use Zarpo

You must be at least 18, live in the United States, and have a US mobile number and a US bank account or debit card. You must give accurate identity details and keep your account information current. One person, one account; you are responsible for everything done through yours.

3. How a pool works

A pool is a group of members who agree to pay the same amount each round. Every round, each member contributes, and one member, in a fixed order, receives the pot. The pool ends when every member has had a turn.

  • The contribution amount, the number of members and rounds, the start date and the due day are set when the pool is created and shown to you before you join. During the beta the contribution is between $5 and $100 per member per round.
  • The payout order is fixed when the last seat is filled and is visible to every member. It does not change while the pool runs.
  • Joining a pool is a commitment to contribute every round until the pool ends, including the rounds after you have received your payout. Leaving is only possible before the pool starts.
  • A contribution is late if it has not been paid by the end of its due date. A late or missed contribution is recorded in your pool history and may be recovered from you under the pool rules shown in the app.
  • A pool that does not fill may be cancelled before it starts, in which case nothing is collected.
  • The pot for a round is the total of the other members' contributions for that round. Zarpo takes no fee during the beta and never takes a share of the pot.

4. Payments

Payments are processed by Stripe. When you connect a bank account or card you authorize Zarpo to collect each contribution you owe on or after its due date, and you agree to Stripe’s terms for the payment method you use. To receive a payout you open a payout account with Stripe, which verifies your identity and pays your balance out to your bank.

  • A contribution is charged to your payment method and settles directly into the payout account of the member receiving that round. Zarpo does not hold member funds.
  • Zarpo is not a bank, does not take deposits, is not insured by the FDIC and pays no interest. Nobody earns a return in a pool; you receive what the members put in.
  • If a payment fails or is returned, you remain responsible for the contribution and any fee your bank charges. You may be asked to pay again with a working method.
  • Payout timing depends on when contributions settle and on Stripe's payout schedule. Bank transfers can take several business days.
  • You can revoke your payment authorization by removing your payment method in the app at least three business days before a due date. Doing so does not end your obligations in a pool you have already joined.

5. Your responsibilities

  • Contribute on time in every pool you join.
  • Give true information about yourself and your payment method.
  • Use Zarpo only for your own savings with people you choose to pool with. Do not use it to lend, to collect fees from others, to launder money or for any unlawful purpose.
  • Be civil in pool chat. Do not post anything unlawful, threatening or abusive, or anyone else's private information.
  • Do not interfere with the service, probe it for weaknesses or access other members' accounts.

6. Ending an account

You can stop using Zarpo at any time and ask us to close your account. We can suspend or close an account that breaks these terms, misses contributions or poses a risk to other members. If an account closes while in a pool, the member’s obligations to that pool continue under the pool rules, and contributions of theirs that have not yet been paid out are returned as those rules provide.

7. Zarpo's role

Zarpo provides the software that organizes a pool: the schedule, the record of who has paid, the messages between members and the instructions to Stripe. The pool itself is an arrangement among its members. Zarpo does not guarantee that other members will contribute and does not make up a shortfall, though it records misses and enforces the pool rules described in the app.

8. Disclaimers and limits on liability

Zarpo is provided as it is, during a beta, without warranties of any kind, and we do not promise it will be uninterrupted or error-free. To the fullest extent the law allows, our total liability to you for anything arising out of Zarpo or these terms is capped at the amount you contributed in the round in which the problem occurred, and we are not liable for indirect, incidental, special or consequential damages, including lost savings, lost time or lost opportunity. Some jurisdictions do not allow these limits, in which case they apply as far as the law permits.

9. Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Virginia.

10. Changes

We may update these terms. When we do we will change the date at the top and, for changes that matter, tell you in the app or by email before they take effect. Continuing to use Zarpo after that means you accept the new terms.
